In June 2022, U.S. District Judge Nancy Torresen ruled in favor of Bailey Archer, granting a summary judgment that found the school’s discipline unconstitutional. The judge ordered the expungement of the suspension from Archer’s academic record. The court determined that while the post was “in poor taste and immature,” it was not equivalent to targeted harassment, true threat, or substantial disruption as defined by First Amendment precedents.
